The Traveller (hereafter named “you” or “your”) and Sama Trips ehf, Kt: 540524-1300 (hereafter named “Samatrip ”, “we”, “our” or “us”), agree to enter into the following:
This Cancellation Policy may be amended from time to time and applies to all of our services.
By accessing, browsing, using, and/or completing a reservation through our website www.samatrip.is you acknowledge and agree to have read, understood, and agreed to the cancellation policy as set out below. The customer making the booking accepts these conditions on behalf of all members of their travel party and is responsible for payment due from the party in its entirety.
CANCELLATION BY Samatrip DUE TO WEATHER & UNEXPECTED EVENTS
Should Samatrip cancel your tour because of weather, or any other unexpected event out of our control, you can rest assured that you refunded the entire cost of the tour.
The weather in Iceland is very unpredictable and cancellations due to weather can happen at any time. Samatrip make every effort to do every tour we operate, but sometimes it’s just not safe or impossible due to road closures. It is your responsibility to provide Samatrips with proper contact details (phone and/or email) so that we can cancel and potentially rearrange your tour in good time.
Samatrip will always endeavor to reschedule your tour or offer a viable alternative as a first action in all cancellation scenarios.
FORCE MAJEURE
Defined as an unforeseeable circumstance that prevents someone from fulfilling a contract beyond the reasonable control of a party. Samatrip reserves the right to suspend or terminate the performance of its obligations when certain circumstances beyond their control arise, making performance inadvisable, commercially impracticable, illegal, or impossible.
These unforeseeable circumstances include (but not limited to) the following: War, riots, fire, flood, hurricane, typhoon, earthquake, volcanic eruptions, lightning, rock slide, explosion, strikes, lockouts, slowdowns, pandemics, epidemics, other public health concerns, international travel restrictions, terrorism, prolonged shortage of energy supplies, and acts
of state or governmental action prohibiting or impeding any party from performing its respective obligations under the contract.
In the event of Force Majeure Samatrip will not be liable for any refunds and this clause will supersede all other cancellation policies, when appropriate. With that said, Samatrip will always endeavor to rearrange, reschedule or change your booking whenever possible.
We again, advise that all travelers take out comprehensive travel insurance that covers Force Majeure and all other eventualities for international travel.
THE PROCESS OF CANCELLATION
All communications relating to these terms and conditions (in particular any requests to cancel or amend your tour arrangements) must be from the lead traveler of each reservation and delivered by email to [email protected] in order to be valid. Once received the amendment and/or cancellation needs to be confirmed by Samatrip before further action can be taken.
If a reimbursement is in order then it shall be made in accordance with all procedures and processed within 7 working days. The stipulated amount will be transferred to the same credit card that was employed for the acquisition of the tour. Please note that we can not be responsible for delays/ or additional transaction fees of the reimbursement to your account once it has been processed by us ,or additional transaction fees or currency conversion fees of the reimbursement to your account once it has been processed by us.
CANCELLATION BY YOU OF SCHEDULED DAY TOURS
All bookings of scheduled tours, operated by Samatrip require a minimum of 24 hours notice to cancel a booking for a 100% refund. If cancellation is made after this time no refund is given. We will always endeavor to reschedule you onto a new trip departure, where possible
CANCELLATION BY YOU OF TAILOR MADE TOURS
If you have booked a private tailor-made with Samatrip, and wish to cancel the following conditions apply: More than 7 days notice we will refund 90% of the cost of the tour. This covers our transactional and direct costs due to cancellation.
Less than 7 days, but more than 48 hours notice, you will be refunded 50% of the tour price.
Less than 48 hours notice no refund is provided. We will always endeavor to reschedule you onto a new trip departure, where possible.
If you have only paid a deposit when the cancellation request is received please note that the cancellation fee is based on the full tour price and not a percentage of the deposit amount.
